PopHaus Collective, LLC d/b/a “It’s Kind of a Fun Story” (“PopHaus,” “we” or “us) is committed to protecting your privacy and the personal information that we collect from you when you visit our website, create an account, or purchase products or services from us (collectively “PopHaus Services”). This Privacy Policy describes the personal information we collect about you, how we use your personal information, how we protect your personal information, and your rights regarding your personal information collected by us.
BY VISITING THE WEBSITE, CREATING AN ACCOUNT, OR PURCHASING PRODUCTS OR SERVICES FROM US, YOU ACCEPT THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY. - USE OF INFORMATION
Use in General. We use information to provide the PopHaus Services, including to analyze, administer, enhance and personalize our services and marketing efforts, to manage member referrals, to process your registration, your orders and payments, and to communicate with you on these and other topics.
Use of General Geographic Location. We use your general geographic location, provide localized content to provide you with customized and personalized recommendations for products and services we think will be of interest to you, determine your ISP to support network troubleshooting for you (we also use aggregated ISP information for operational and business purposes), and help us quickly and efficiently respond to inquiries and requests
Use of Precise Location Data. In order to access certain PopHaus Services from your computer or mobile device, you may be required to share your device’s precise location data (e.g., latitude and longitude) with us. In addition to providing, you with certain PopHaus Services, this also enables us to serve you Content related to your local area such as news and sports, depending on your subscription. This data may also be used to tailor advertising to you based on your location. To learn more about your choices with respect to our collection and use of precise location data, please see the information we have provided in Section 7 (“Opt-Out Options”).
Use of Information with Partners. We use your information to coordinate with Partners on making the PopHaus service available to members and providing information to non-members about the availability of the PopHaus service, based on the specific relationship you have with the Partner; secure our systems, prevent fraud, and help us protect the security of PopHaus accounts.
Use of Information to Prevent Illegal Activity. We use your information to prevent, detect and investigate potentially prohibited or illegal activities, including fraud, and to enforce our terms (such as determining whether and for which PopHaus signup offers you are eligible and determining whether a particular device is permitted to use the account consistent with our Terms of Use)
Use of Information to Improve Service. We use your information to analyze and understand our audience, improve our service (including our user interface experiences and service performance) and optimize content selection, recommendation algorithms and delivery; and communicate with you concerning our service so that we can send you news about PopHaus, details about new features and content available on PopHaus, special offers, promotional announcements, consumer surveys, and to assist you with operational requests such as password reset requests. These communications may be by various methods, such as email, push notifications, text message, online messaging channels, and matched identifier communications (described below). Please see the “Your Choices” section of this Privacy Policy to learn how to set or change your communications preferences.
Use of Aggregate or De-Identified Information. In addition to the individual data use described in this Privacy Policy, we may aggregate information about you and other individuals together, or otherwise “de-identify” the information about you (which means that the information does not directly or indirectly identify you). We may use information in these forms for any legitimate business purpose, including for research and analysis, administration of the PopHaus Services, advertising (e.g., improving our targeting efforts), and promotional purposes.
Use of Information to Third Parties. We may disclose personal information to our third-party contractors, such as Shopify, and payment processors who perform services for us in connection with our website, or to complete or confirm a transaction or series of transactions that you conduct with us. We may also disclose personal information to service providers or suppliers if the disclosure will enable that party to perform business, professional or technical support for us. Any information you provide on a third-party’s website, such as Shopify, is subject to their privacy policies.
- COLLECTION OF INFORMATION
We collect personal information from and about you when you visit our website, download our mobile application, create an account, or purchase products or services from us.
Automatic Information. When you browse our website, we may track certain information about your activities. This information may include the URL that you just came from, which URL you next go to, what browser you are using and your IP address. We may use this information to analyze your behaviors, interests and demographics to help us better understand and serve our Users.
Cookies and Other Identifiers. We may also use “cookies” to identify you when you visit our website in order to facilitate access to certain features or store information regarding you between visits to the website. “Cookies” are small pieces of information that a web site will store on your computer’s hard drive. Cookies are never used to store sensitive information such as names, addresses, credit card numbers or passwords. If you wish to prevent our ability to use cookies, consult your browser’s “Help” function for instructions on how to disable cookies.
Information You Provide to Us. We may also request and collect identifying information about you, such as your name, email address, phone number, billing information, shipping information and other personal information as indicated on forms set forth on the website. You provide this personal information when you interact with us, such as when you create an account, purchase products and services from us, sign up for promotions, and provide user feedback or reviews. It is your choice to provide this information and you are not required to do so unless it is necessary to complete your desired transaction with us.
Information From Partners. We collect information from other companies with whom you have a relationship (“Partners”). These Partners might include (depending on what services you use): your TV or internet service provider, or other streaming media device providers who make our service available on their device; mobile phone carriers or other companies who provide services to you and collect payment for the PopHaus service for distribution to us or provide pre-paid promotions for the PopHaus service; and voice assistant platform providers who enable interaction with our service through voice commands. The information Partners provide us varies depending on the nature of the Partner services, and may include: search queries and commands applicable to PopHaus that you make through Partner devices or voice assistant platforms; service activation information such as your email address or other contact information; or IP addresses, device IDs or other unique identifiers, as well as associated pre-paid promotion, billing and user interface information, that support user authentication, the PopHaus service registration experience, Partner payment processing, and the presentation of PopHaus content to you through portions of the Partner user interface.
Information From Other Sources. We also obtain information from other sources. We protect this information according to the practices described in this Privacy Policy, plus any additional restrictions imposed by the source of the data. These sources vary over time, but could include: service providers that help us determine a location based on your IP address in order to customize our service and for other uses consistent with this Privacy Policy; security service providers who provide us with information to secure our systems, prevent fraud and help us protect the security of PopHaus accounts; payment service providers who provide us with payment or balance information, or updates to that information, based on their relationship with you; online and offline data providers, from which we obtain aggregated demographic, interest based and online advertising related data; or publicly-available sources such as publicly available posts on social media platforms and information available through public databases associating IP addresses with internet service providers (ISPs).
- DISCLOSURE OF INFORMATION
We do not sell or share your personal information, except as set forth below.
Third-Party Service Providers. We employ other companies and individuals to perform certain functions, including but not limited to fulfilling orders, delivering packages, sending postal mail and email, developing systems, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service. We may provide your personal information to these third-party service providers as necessary to perform such functions for us. Your personal information may not be used by these third-party service providers for any other purpose other than to perform the services provided to us.
Partners. As described above, you may have a relationship with one or more of our Partners, in which case we may share certain information with them in order to coordinate with them on providing the PopHaus service to members and providing information about the availability of the PopHaus service. For example, depending on what Partner services you use, we may share information: in order to facilitate Partner pre-paid promotions or collection of payment for the PopHaus service for distribution to us; with Partners who operate voice assistant platforms that allow you to interact with our service using voice commands; and so that content and features available in the PopHaus service can be suggested to you in the Partner’s user interface. For members, these suggestions are part of the PopHaus service and may include customized and personalized viewing recommendations.
Promotional offers. We may offer joint promotions or programs that, in order for your participation, will require us to share your information with third parties. In fulfilling these types of promotions, we may share your name and other information in connection with fulfilling the incentive. Please note that these third parties are responsible for their own privacy practices.
Legal Process. We may be required to transfer or disclose your personal information to comply with a legal obligation, subpoena or other demand from governmental authorities, or when we reasonably believe the law requires such disclosure. We also reserve the right to share your personal information with legal authorities and other companies for fraud protection and credit risk reduction, to detect any technical or security vulnerabilities, to enforce our Terms of Use or other applicable policies, or to otherwise protect the rights, property, safety, or security of third parties, Users of our website, and PopHaus.
Sale of Business. In the event we ever sell or transfer all or a portion of our business, such transaction will likely involve the transfer of your personal information if it is still held by us at that time. We will use commercially reasonable efforts to require the acquirer of your personal information to protect it in a manner consistent with our Privacy Policy in effect at the time of such transaction.

While no system is completely secure, we believe that we have implemented reasonable measures to reduce the likelihood of an unauthorized disclosure of your personal information. If you have created an account, you may access and update your registration information by accessing your profile through our website.

We use reasonable administrative, logical, physical and managerial measures to safeguard your personal information against loss, theft and unauthorized access, use and modification. These measures are designed to provide a level of security appropriate to the risks of processing your personal information.
Despite these efforts, please note that there is always a possibility that a breach in data transmission or storage may occur and we cannot guarantee the security of any information from or about you 100% of the time. Please note that if you allow others to use your account (including others you permit to set up profiles under your account), they may be able to view information about your account or any of the profiles under your account, including information about the videos you view and your email address.
- OPT-OUT OPTIONS
The personal information collected and used to perform the services will be retained unless and until you ask us to delete information. The retention of this data is necessary for provision of the Services and analysis of historical performance. You may contact us at admin@pophauscollective.com to learn what information we have collected about you and to ask that any such personal information be corrected, updated, or deleted. Should you choose to delete any personal information collected by us, you acknowledge that the PopHaus Services may not function as intended.
- CHILDREN
You must be at least 18 years of age or older to subscribe to the PopHaus service. Minors may only use the service with the involvement, supervision, and approval of a parent or legal guardian. - CHANGES TO THIS PRIVACY POLICY
We will update this Privacy Policy from time to time in response to changing legal, regulatory or operational requirements. We will provide notice of any such changes (including when they will take effect) in accordance with law. Your continued use of the PopHaus Services after any such updates take effect will constitute acknowledgement and (as applicable) acceptance of those changes. - APPLICABLE LAW
PopHaus Collective, LLC is headquartered in the State of Illinois, United State of America (“U.S.”) and the PopHaus Services are intended for users in the U.S. By viewing any Content or otherwise using the PopHaus Services, you consent to the transfer of information to the U.S. to the extent applicable, and the collection, storage, and processing of information under Illinois and U.S. laws.
- CALIFORNIA CONSUMER PRIVACY ACT
You have the right to know what data of yours is being collected and to review what data we have collected about you, as well as the right to ask that your personal information be corrected, updated, or deleted. If you wish to exercise these rights, please see Section 7.
